Maths Magician Terms and Conditions

1. Definitions and interpretation
In these Terms and Conditions (“Terms”), unless the context otherwise requires, the following words and expressions shall have the meanings set out below. Words in the singular include the plural and vice versa.
Client / You
The parent, guardian or adult learner entering into an agreement with Maths Magician for tuition and/or subscription services.
Student
The individual receiving tuition and/or access to the Maths Magician learning platform.
Individual Tuition
Tuition provided by one tutor to one student.
Maths Magician
The business owned and operated by Clare Knight providing online mathematics tuition and subscription-based learning resources.
Parent Portal
The area of the Maths Magician learning platform providing parents or guardians with access to learning journals, tutor comments and other information relating to their child.
Subscription
Paid access to the Maths Magician online learning platform.
Tuition Fee
The published fee for tuition sessions as displayed on the Maths Magician website.
Tutor
Any representative of Maths Magician providing tuition or educational support.
Website
The Maths Magician website and online learning platform.
We / Us / Our
Maths Magician.
2. Acceptance of these Terms
2.1
By booking tuition, purchasing a subscription, creating an account, accessing the Parent Portal or attending tuition, you confirm that you have read, understood and agree to be bound by these Terms.
2.2
You must also read and accept our Privacy Policy and Safeguarding Policy, both of which are available on the Maths Magician website. Continued use of our services constitutes acceptance of those policies.
3. Tuition Fees and Subscription Payments
3.1
Tuition fees are payable within seven days of the tuition session taking place.
3.2
At the time of booking you will receive an email containing a payment link should you wish to pay in advance.
3.3
Approximately 24 hours before each lesson you will receive a reminder email containing a payment link.
3.4
Within one working day following tuition you will receive an invoice containing a payment link.
3.5
Subscriptions are payable weekly in advance or every four weeks in advance, at your choice. The first week of subscription will be provided free from an agreed start date.
3.6
Payment of tuition fees confirms the continuation of future booked tuition sessions.
3.7
Where payments remain outstanding beyond the due date, Maths Magician reserves the right to suspend future tuition until the account has been brought up to date.
3.8
Where payments are repeatedly received late, Maths Magician reserves the right to require payment in advance before future tuition sessions take place.
3.9
Cancellation of a subscription will end access to subscription content at the end of the current paid subscription period unless otherwise agreed.
4. Cancellations
4.1
If you are unable to attend a tuition session and provide at least 12 hours’ notice, you may use the reschedule link contained within your reminder email to select another available appointment.
4.2
If less than 12 hours’ notice is available, please contact Maths Magician directly. Every effort will be made to rearrange the lesson although this cannot be guaranteed.
Where tuition has already been paid for, payment will normally be transferred to the rearranged lesson unless a refund is requested.
4.3
If a student misses three consecutive lessons without arrangements being made, Maths Magician will assume tuition is no longer required and future appointments may be cancelled.
4.4
Should Maths Magician need to cancel a lesson due to circumstances beyond our reasonable control, any tuition fees already paid will be refunded in full or transferred to a rearranged lesson, according to your preference.
5. Termination
5.1
Tuition or subscriptions may be ended at any time by either party.
5.2
Maths Magician reserves the right to suspend or terminate accounts where:
tuition fees remain unpaid;
these Terms are repeatedly breached;
abusive or inappropriate behaviour occurs;
login credentials are shared with others;
the learning platform is misused.
6. Online Learning Platform
6.1
Subscriptions are provided for the named student only and must not be shared with any other person.
6.2
Maths Magician may add, remove or update learning materials at any time in order to improve the learning experience.
6.3
Temporary interruptions to the learning platform may occasionally occur due to maintenance or circumstances beyond our control.
6.4
Level Up XP, badges, achievements, leaderboards and similar gamification features are provided solely for educational motivation and hold no monetary value.
7. Parent Portal
7.1
The Parent Portal is intended to improve communication between Maths Magician and parents or guardians.
7.2
Tutor comments and lesson summaries represent the professional opinion of the tutor at the time they are written.
7.3
Parents are encouraged to contact Maths Magician if they require clarification regarding any comments or recommendations.
8. Intellectual Property
8.1
All worksheets, quizzes, videos, images, lesson materials, activities, learning resources and other content provided by Maths Magician remain the intellectual property of Maths Magician unless otherwise stated.
8.2
These materials may be used only by the named student and must not be copied, redistributed, shared, published or sold without prior written permission.
9. Limitation of Liability
9.1
Maths Magician shall not be liable for any indirect or consequential loss arising from tuition or use of the learning platform except where liability cannot legally be excluded.
9.2
Whilst every effort is made to support each student’s progress, Maths Magician cannot guarantee improvements in academic performance, examination results or school assessments.
9.3
Parents or guardians remain responsible for the supervision of children when accessing online learning materials where appropriate.
10. Data Protection and Record Retention
10.1
Student information will be processed in accordance with our Privacy Policy.
10.2
Learning records, tutor comments and account information may be retained for a reasonable period following termination of tuition or subscription in accordance with our Privacy Policy and applicable data protection legislation.
11. Governing Law
11.1
These Terms are governed by the laws of England and Wales.
11.2
Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.
11.3
These Terms constitute the entire agreement between the parties.
11.4
Maths Magician reserves the right to amend these Terms from time to time. Where changes are made, clients will be notified and, where appropriate, asked to accept the updated Terms before continuing to use the service.
