Terms and conditions

1 - Definitions and interpretation

In these terms and conditions, as amended from time to tome (these ‘Terms’) the following words and phrases shall have the meanings set out opposite them unless otherwise clearly stated to the contrary and the singular shall include the plural and vice versa:

Attending

Pertains to online attendance.

Individual tutoring

Tutoring provided on the basis of a tutor providing tuition to a tutee.

Maths Magician

A business owned by Clare Knight trading as Maths Magician.

Group tuition

Any form of tuition where a maximum of 5 tutees attend a session at the same time and pay for tuition from a single tutor.

Tuition fee

The amount(s) charged for tuition, details of which (as updated from time to time) are available on the Website.

Tutee/You

Each person who signs up with Maths Magician to receive tuition.

Tutor

Any representative of Maths Magician offering tuition pursuant to these terms.

2 - Terms and conditions and our policies

2.1 If you contact us to request tuition then you agree to abide by, and that the provision of any tuition will be governed by, these terms.

2.2 You must, prior to receiving any tuition, read our policies in relation to safeguarding and privacy - both of which are available on the website. You will, by attending to receive any tuition, be deemed to have understood and agreed to those policies.

3 - Fees and payment

3.1 All tuition fees are payable within 7 days of the tuition having taken place. There are 3 routes to payment given in points 3.2, 3.3 and 3.4. You may choose any payment method that is convenient for your circumstances.

3.2 At time of booking you will be sent an email with a link for advance payment.

3.3 24 hours in advance of a tutor session you will be sent an email reminding you of the appointment, this email will contain a link for payment.

3.4 After the tuition has taken place, but not more than 1 working day, you will be sent an email invoice requesting payment for the tuition and including a link for payment.

3.5 Payment of tuition fees in accordance with clause 3.1 - 3.4 above will deem to constitute confirmation of the next booked tuition session. If any payments invoiced for pursuant to clause 3.1 are not paid for by the stated due date then future tuition sessions will not proceed, unless payment is brought up to date.

3.6 At the discretion of the staff at Maths Magician, if payment is persistently late, but clients wish to continue with tuition a system of payment in advance will be instigated to guarantee the lesson goes ahead. This will be instigated on a case by case basis.

4 - Cancellations by client

Cancellations by client

4.1 If you are unable to attend a tutor session and sufficient notice (being not less than 12 hours) is available, you may use the reschedule link sent in the email 24 hours before the tuition time, to reschedule to an available time.

4.2 If less than 12 hours before the tutor session you will contact Maths Magician directly. The tutor will endeavour to reschedule the session, but this cannot be guaranteed. Any payments made in advance will be held to pay for the next tutor session, unless a refund is requested.

Cancellation due to unforeseen circumstances:

4.3 If tutor sessions cannot go ahead due to unforeseen circumstances beyond our reasonable control and need to be cancelled by Maths Magician, then you will be refunded fully - subject only to deduction of any costs which we have incurred and relation to which we would otherwise be out of pocket.

5 - Termination

5.1 Tuition sessions will continue until either a mutually agreed termination date or in the event that you fail to pay for any sessions in accordance with clause 3 of these terms.

6 - Limitation of liability

6.1 Maths Magician shall not be liable for any loss, expense, damage, delay, costs or compensation which may be incurred by you as a result or arising (directly or indirectly) from the tuition, other than where (and to the extent) it is otherwise prescribed by law.

6.2 Whilst we work hard to support and extend the learning of all tutees, this cannot be guaranteed and we are not responsible for any tutees lack of progress, exam failure and/or negative school report grades.

7 - Jurisdiction, entire agreement and governing law:

7.1 These terms and the resulting agreement are governed by the laws of England and Wales and we and you submit to the exclusive jurisdiction of the Courts of England and Wales in the case of any dispute (contractual or non-contractual).

7.2 These terms constitute the whole agreement between us and you and no variation or alteration of these terms shall be valid unless approved in writing by Clare Knight.

7.3 We reserve the right to alter these terms from time to time and will notify you in writing in the event of any changes.
